Vatican II did not say that "man has the right before God, however he may before the state, to hold any religion". Dignitatus Humanae said the exact opposite about man's and societies's obligation to the truth. But it just is considered imprudent to repress heresies these days. I don't know who was responsible for Italy ceasing to have an established religion, but there are South American countries that have Catholicism as the official religion.
A right "not to be prevented" is a right. Nobody has a right to do wrong.

It qualifies it several times with appeals to the "puplic order". Gregory XVI said that heresies can disrupt the public order

Saying heresy can be tolerated and saying there is a right not to be prevented from spreading error are two different things.
