I would be making too big a deal of it, if what His Eminence deserved was anything short of deposition.  As the matter stands, I think having such a pro-sodomite cleric in the CDF is no less than insane, and if I were a little less charitable, I would regard it as pure evil.

In essence, yes.  Catholics in mortal sin have cut themselves off from the mystical body of Christ.  They aren't canonically cut off because excommunication is also a legislative act that is supposed to reflect the interior disposition of the person excommunicated as judged by external circumstances.   

I think it's the Trent catechism that states that even the excommunicated are still subject to the Church. 

And some of the forms of absolution have often referred to absolving all excommunications a person may have incurred between confessions. 

The most obvious example would be someone procuring an abortion or aiding a person in procuring an abortion.  They've excommunicated themselves, sinned mortally and are required to go to confession.  When they go to confession they are re-incommunicated.

How is he pro-sodomite? I hate being too technical, but I don't think that label applies to the lesbian denial of communion case ... unless there is something else out there.

My understanding is that this is the last in a long line of such problems with His Eminence.  If you want to insist, I suppose I would have to put up or shut up-- and for right now, it would have to be shut up, as I have way too much research and such to do this week anyway.  But I'm pretty confident that this Cardinal is as much a prince of Anti-Christ's church as of Christ's.
